Introduction
This given case is under the chapter of agreement under the contract law .Offer refers to the signification by one person to another of his willingness to enter in to a contract with him on certain terms. It may be expressed or implied from the conduct of the parties.
A contract is formed where there is an offer, an acceptance, consideration and an intention to create legal relations. An offer is distinguished from an "invitation to treat" because the latter lacks that intention to be legally bound. In this case, when Joshua has decided to try and sell his car by parking it outside his house with a notice on the windscreen stating “For sale. Pristine example-one owner RM80,000.00 or near offer. Please call number 38 or telephone 03-7552525, only.” it is merely an invitation to treat because price tag on goods is not an offer to sell the goods at that price as referred to caseCarlill V/S Carbolic Smoke Ball Co. Carbolic smoke ball co, advertise in paper. An invitation to treat is requesting people to make an offer for the goods.
