David Hicks is an Australian man being held in Guantanamo Bay, Cuba by the US Government. He is accused of taking part in terrorist activities in Afghanistan. He was captured in December 2001, but there was a three-year wait before the charges of attempted murder conspiracy, and aiding the enemy were officially made against him.
The issue of David Hick's case is if he should be brought back to South Australia to finish the rest of his sentence, and when he should return. If he does return to Australia, there is the further matter of if he should be put in solitary confinement, as he was in Guantanamo Bay. Hicks will be held at Yatala Prison, Adelaide as a federal prisoner, if his May 29 return occurs.
The US military have stressed that they are in no rush to finalise arrangements regarding the transfer. The South Australian Minister of Correctional Services, Carmel Zollo currently expects the finer details of his sentencing within the week. David Hicks' lawyer, Major Michael Mori has spent this week explaining to him the details of his return to Australia. It is believe that he has also given advice as to if he should continue his legal action against Australia and the US.
This is an international issue that affects three major countries, Australia, Britain and the United States. The article uses a lot of legal language to describe the situation. David Hicks, the American Supreme Court, the US military and the Australian Federal Government are all involved in this issue. This was a large issue in the past, because it could have caused trouble between the US and Australia. But since then, many of the smaller issues that made up the larger picture have been resolved, and it is now a medium-sized issue.
