To whom it may concern:
I’m disputing a creditor and balance on my credit report. The creditor is Bayou Federal Credit Union and the balance is over $10,000. I had filed for Bankruptcy Chapter 13 on June 27, 2004, and then converted over to Chapter 7 on March 29,2006. In both Chapters I included Blue Cross (Blue Shield) Federal Credit Union which I was actively conducting business by making monthly payments during Chapter 13. When I converted over to Chapter 7, (Blue Cross {Blue Shield} Federal Credit Union) was also included but at this point I stopped making payments because of the laws of Chapter 7. Once I received my discharge papers showing the case was closed from the Federal Courthouse, Blue Cross (Blue Shield) Federal Credit Union was officially (lawfully) paid off.
Well, sometime early in 2007 (between February and April), I received a statement in the mail from Bayou Federal Credit Union with a payment book included showing my next payment was due. I immediately called Bayou Federal Credit Union to dispute the payments and the account. The branch manager Rick Sanchez and loan department manager Marcell Myers explained to me the payments and account. During the conversation, between the managers and me, I found out that Blue Cross {Blue Shield} Federal Credit Union was bought out by Bayou Federal Credit Union. I told them that the account (which is for a 2002 Avalanche) was discharged off. {The Avalanche was totaled, the insurance paid the value, and the balance left was discharged off in Chapter 7}. They verbally told me to ignore the payment book and the account, that they would resolve the situation on my credit report.
Well, I’ve applied for credit in September/October several times. Since, I have a business relationship with one of my creditors, I was able to establish a credit history with them and they approved me for a major credit card. However, they explained to me that Bayou Federal Credit Union was still showing on my Credit Report. I called Bayou Federal Credit Union again, spoke with loan department
