Search Warrant

I am requesting a search warrant for the residence, any outbuildings, and curtalage, refuse containers, and the green Honda located at 610 North Buchanan Blvd, Durham NC. The purpose of the warrant is to afford the search of evidence in the rape that allegedly took place at the aforementioned address on 3/14/06. Evidence to be searched for includes: any and all sources of DNA such as blood, hair, skin, and semen that formerly belonged to the suspects and the alleged victim. Also I am requesting a warrant to procure from the suspects and alleged victim DNA and fingerprint samples in order to compare to any found at the scene of the alleged rape. Also to seize any articles, or remnants such as torn material or adornments from the clothing belonging to the alleged victim, and all articles of clothing worn by the suspects at the time of the alleged rape, as described by the alleged victim. I also wish to be seized all means of recording the events of the night to include cameras (digital, film, and video) along with all storage media that may be used in those devices.

The residency located at 610 North Buchanan Blvd, Durham NC to include all curtalage of the property, and the green Honda that was parked at the residence at the time of the alleged rape.

Situation Presenting Probable Cause

On 3/14/06 at 1.22am Durham City police officers were called to a parking lot on Hillsborough Road. There they spoke with a woman who said she had been sexually assaulted at 610 North Buchanan Blvd. The victim and another female had an appointment to dance at that residence. The victim arrived at the residence and joined the other dancer. The victim reported that they began to perform their dance in the master bedroom areas. After a few minutes, the males watching them started to get excited and aggressive. The victim and the other female decided to leave. They were concerned about their safety. As the two women got into a vehicle, they were approached by one of the men. He apologized and asked that the females return. Shortly after going back into the dwelling the two women were separated. Two males Adam and Matt pulled her into the bathroom. Someone closed the door to the bathroom where she was and said "sweet heart you can't leave". The victim
