Resolution On The Kashmir Issue

Recommends to the Governments of India and Pakistan the following measures as those which in the opinion of the Council are appropriate to bring about a cessation of the fighting and to create proper conditions for a free and impartial plebiscite to decide whether the State of Jammu and Kashmir is to accede to India or Pakistan

The SPECIAL POLITICAL & DECOLONIZATION Committee,

Having considered the complaint of the Government of India concerning the dispute over the State of Jammu and Kashmir;

Having heard the representation of India in support of that complaint and the reply and counter-complaints of the representative of Pakistan;

Being strongly of the opinion that the early restoration of peace and order in Jammu and Kashmir is essential and that India and Pakistan should do their utmost to bring about a cessation of all fighting;

Noting with satisfaction that both India and Pakistan desire that the question of the accession of Jammu and Kashmir to India, Pakistan or Azad Jammu and Kashmir should be decided through the democratic method of a free and impartial plebiscite;

Considering that the continuation of the dispute is likely to endanger international peace and security,

Recommends to the Governments of India and Pakistan the following measures as those which in the opinion of the Council are appropriate to bring about a cessation of the fighting and to create proper conditions for a free and impartial plebiscite to decide whether the State of Jammu and Kashmir is to accede to India, Azad Jammu and Kashmir or Pakistan.

1. Suggests the introduction of an unbiased peacekeeping force from countries other than India and Pakistan, in the buffer zone between India and Pakistan, thus restricting the access of terrorist organizations in the region. This force would comprise of troops from France, UK, and USA. Also these peacekeeping forces should be deployed for a specified time period which would be reconsidered every 6 months;

2. Suggests the formation Of a new country Azad Jammu and Kashmir;

3. Suggests that all further Kashmir related pacts between India and Pakistan be overlooked by the UN so that they will be upheld to standard international law;

4. Recommends that a UN supervised plebiscite should be held in Kashmir so that the people can voice their opinions. This will be taken into consideration in the redrawing of Kashmiri boundaries. There will be no political intervention of any kind so as to protect the citizens from misleading propaganda and allow them to vote in accordance with their views. The plebiscite would be supervised by the HRW and the UN Human Rights Commission. The results of this plebiscite would be implemented by the UN Security Council and the new borders would be maintained by the peacekeeping force;

5. Urges China, India and Pakistan to empower NGOs and other organizations to take the following actions in order to prevent violation of human rights of the Kashmiri population;

Introduce rehabilitation centers for the mentally traumatized ;

Every individual deserves a fair trial before imprisonment as approximately 4000 individuals have been imprisoned based on discriminatory reasons;

These implications will be funded by France and U.K;

6. Based on Kashmir’s map and the rivers cutting across Kashmir, a joint HEP project should be implemented which would benefit the entire region of Kashmir as well as India, China, Pakistan and Azad Kashmir;

This would help the region whether it becomes a part of India, Pakistan, China or Azad Kashmir. UNDP and ADB will finance this project. This power project should be implemented within a period of 6 months;

7. Urges detention facilities be installed for all those violating basic human rights laws. Suggests that the country that is in control of the area concerned implement the above detainments;

Proposes funding for establishment of necessary facilities from India, China and Pakistan.

8. To develop Kashmir as an Industrial state, subsidies should be provided to industries. Certain other incentives should also be provided so that Indian firms as well as MNC’s are encouraged to establish at least their production units in Kashmir.
